THIS IS AN ATTEMPT TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.

Under and by virtue of the Power of Sale contained in a Security Deed given by Deborah Wallis Williams to Bank of America, N.A., dated April 11, 2007, and recorded in Deed Book 3983, Page 50, Carroll County, Georgia Records, as last transferred to U.S. Bank Trust National Association, as Trustee of the Cabana Series IV Trust by assignment recorded in Deed Book 5781, Page 3 in the Office of the Clerk of Superior Court of Carroll County, Georgia Records, conveying the after-described property to secure a Note in the original principal amount of one hundred twelve thousand two hundred and 00/100 ($112,200.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Carroll County, Georgia, within the legal hours of sale on Tuesday, October 6, 2020, the following described property:

ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN LAND LOT 254 OF THE 6TH DISTRICT, CARROLL COUNTY, GEORGIA, BEING LOT 24, AND PART OF LOT 25, LEDBETTER TRACE SUBDIVISION, PHASE II, AS PER PLAT RECORDED IN PLAT BOOK 51, PAGE 167, CARROLL COUNTY, GEORGIA, RECORDS AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:

BEGINNING AT A POINT ON THE NORTHERN RIGHT OF WAY LINE OF CLIFF COURT (HAVING A 50 FOOT RIGHT OF WAY) AT THE SOUTHEAST CORNER OF LOT 23, AFORESAID SUBDIVISION, AND THE SOUTHWEST CORNER OF LOT 24, AFORESAID SUBDIVISION; RUNNING THENCE NORTH 00 DEGREES 23 MINUTES 46 SECONDS WEST 200.00 FEET TO AN IRON PIN FOUND; RUNNING THENCE NORTH 89 DEGREES 36 MINUTES 14 SECONDS EAST 100.00 FEET TO AN IRON PIN PLACED AT THE NORTHWEST CORNER OF LOT 25; RUNNING THENCE SOUTH 11 DEGREES 45 MINUTES 06 SECONDS EAST 109.96 FEET TO AN IRON PIN PLACED; RUNNING THENCE SOUTH 12 DEGREES 34 MINUTES 13 SECONDS WEST 95.61 FEET TO A POINT ON THE NORTHERN RIGHT OF WAY LINE OF CLIFF COURT AT THE SOUTHEAST CORNER OF LOT 24; RUNNING THENCE SOUTH 89 DEGREES 36 MINUTES 14 SECONDS WEST A DISTANCE OF 100.00 FEET TO THE POINT OF BEGINNING. ALL AS SHOWN ON THAT PLAT OF SURVEY BY TIBBITTS LAND SURVEYING, INC. DATED 11/21/95.

The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney’s fees (notice of intent to collect attorney’s fees having been given).

To the best knowledge and belief of the undersigned, the party in possession of the property is Deborah Wallis Williams or tenant(s); and said property is more commonly known as 174 Cliff Court, Villa Rica, GA 30180.

The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
