STATE OF GEORGIA COUNTY OF CARROLL NOTICE OF SALE UNDER POWER Under and by virtue of the power of sale contained in a Security Deed from ANDREA DRIVER N/K/A ANDREA MACK to West Georgia National Bank l/k/a First National Bank of Georgia dated April 26, 2006, recorded May 1, 2006, in Deed Book 3534, Page 291, Carroll County, Georgia records, as modified by Modification Agreements recorded in Deed Book 3566, Page 107; Deed Book 3657, Page 4; Deed Book 3722, Page 143 and Deed Book 3996, Page 131, Carroll County, Georgia records, as transferred to Community & Southern Bank pursuant to that certain Purchase and Assumption Agreement dated as of January 29, 2010, by and among Community & Southern Bank, The Federal Deposit Insurance Corporation, Receiver of West Georgia National Bank l/k/a First National Bank of Georgia and The Federal Deposit Insurance Corporation, and as assigned to COMMUNITY & SOUTHERN BANK by Assignment recorded in Deed Book 4765, Page 34, Carroll County Records, said Security Deed being given to secure a Note from ADAMSON SQUARE, LLC, BRIAN ERIC MACK, ANDREA MACK and RICHARD CULPEPPER April 25, 2007 in the original principal amount of Three Hundred Forty Seven Thousand Six Hundred Fifty Two and 63/100 ($347,652.63) Dollars; said Security Deed also given to secure a Note from ADAMSON SQUARE, LLC d/b/a SMARTLIFE COMPANY, BRIAN ERIC MACK and ANDREA MACK dated February 26, 2009, in the original principal amount of One Hundred Four Thousand Eighty Eight and 67/100 ($104,088.67) Dollars; said Security Deed also given to secure a Note from ADAMSON SQUARE, LLC d/b/a SMARTLIFE COMPANY, BRIAN ERIC MACK and ANDREA MACK dated February 26, 2009, in the original principal amount of Twenty four Thousand Two Hundred Ninety Seven and 53/100 ($24,297.53) Dollars, with interest from date at a rate per cent per annum on the unpaid balance until paid; there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Carroll County, Georgia, within the legal hours of sale on the first Tuesday in November, 2012, the following described property: All that tract or parcel of land lying and being in Land Lot 18 of the 6th District of Carroll County, Georgia, being designated as Lot 25 of Country Lake Estates, as more particularly described on an individual survey for “Richard T. Culpepper,” prepared by Crawford & Associates, Inc., certified by Douglas C. Crawford, Georgia Registered Land Surveyor No. 1833, said survey being dated 2/18/97, and recorded in Plat Book 59, Page 142, of the Carroll County Georgia Public records, which plat and the record therein are by reference incorporated herein. Said lot containing 2.24 acres. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, easements, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above; including but not limited to that certain Deed to Secure Debt from Andrea Driver to Chase Manhattan Bank USA, NA, recorded in Deed Book 2959, Page 61, Carroll County, Georgia records.
